This text amendment to the City's Comprehensive Plan addresses two matters:
1. Exhibit A. The introduction of a Property Rights Element into the Comprehensive Plan. This model element is in accordance with the provisions of SB 59 (Fla. Stat. § 163.3177(6)(i)), passed during the 2021 Florida Legislative Session, signed into law by Gov. DeSantis, and incorporated into Florida’s Community Planning Act.
Every city and county in Florida shall “include in its comprehensive plan a property rights element.” The City must adopt this new element “by the earlier of the date of its adoption of its next proposed plan amendment that is initiated after July 1, 2021, or the date of the next scheduled evaluation and appraisal of its comprehensive plan.” The text of the proposed element is based on a model element authored by the 1000 Friends of Florida. The New element also removes existing property rights policies from Element 1 (see Exhibit B) of the City's Comprehensive Plan and replaces them with equivalent language within the new element.
2. Exhibit B. The text amendment also proposes to fix an issue within the table of future land uses within Element 1. The proposal removes the mandatory requirement to have 25% of residential within the marine/Industrial designation by increasing the non-residential limit from 75% to 100%.
