The "Downtown Stuart Outdoor Seating Strategy" was approved in February 2012 but was formally adopted via Resolution No. 09-2020 in October 2020. The adopted plan allows only umbrellas for shade within the outdoor dining area under this Downtown Outdoor Dining Program (see pages 27-28).
Staff has received several inquiries from restaurants regarding installing various shade structures over the outdoor seating deck to provide a more comfortable dining experience for customers. The restaurant owners have expressed that umbrellas have to be replaced constantly and is not cost effective, and the base is a tripping hazard. Because of the pandemic and a rise in costumers requesting to sit outdoor for dining, the restaurants would like to exceed their customers' dining experience by providing a proper covered area to allow customers to sit outside during less optimal weather conditions, especially rainy days and warmer months. Restaurants have expressed concerns about their financial stability during the pandemic and going out of business if economic conditions remain, especially as we go into a slow season.
Restaurants believe that customers are more likely to sit outside if the outdoor dining area is inviting and provides comfortable space. A busy outdoor dining area draws attention to the restaurant attracting customers especially during off-peak season, otherwise the restaurant can easily go unnoticed or looks closed, adding to the economic impact. An attractive and vibrant outdoor dining setting has a potential to bring more visitors and pedestrian activities to downtown and creating an urban environment.
The restaurants have an Outdoor Dining License Agreement with the City to use the public right-of-way for the Outdoor Dining Program in downtown.
The CRA received a Business Improvement Reimbursement Program (BIRP) grant application from LouRonzo's to install a pergola shade structure over their existing outdoor dining deck area on public property (see attached application). The proposed shade structure doesn't meet the current Outdoor Dining Program guidelines for canopy or shade covering over the outdoor dining area. With the changing environment conditions and consumer behavior, staff is looking for direction on types of shade structure options, other than an umbrella, which may be permitted for the Downtown Outdoor Dining Program. Staff has attached some examples including pergola, shade sail and tiki umbrella for consideration. The design of the structure and fabric/material should compliment the building and blend seamlessly with restaurant theme and décor. Staff recommends that shade structure shall be provided within the designated outdoor dining deck area only. Any permanent structure would require a building permit.
An amendment to the Downtown Stuart Outdoor Seating Strategy will be required to allow other types of canopies or permanent structures recommended by the board.
