In the 2017 referendum, the electors authorized the City of Stuart to lease this waterfront property for a period in excess of 10 years.  In 2018, the City Commission approved a 20 year lease.  The substantive terms of the 2018 lease will remain the same.  During the Covid restrictions, Mulligan's created an outdoor dining area under the building and would like to continue the operation.   In order to remain in compliance with parking regulations, the proposal is to allow Mulligan's to count the parking in the lot behind the Stuart Feed Shop - although it will remain open to the public.  As consideration for this amendment, Mulligan's has agreed to give the City of Stuart an Easement across the parking lot at any time during the lease.  This will provide the City with flexibility when participating in workshops and discussions regarding redevelopment of the area including but not limited to extending Osceola or other potential designs.  The impact of the outdoor dining will be minimal in light of the fact that it has been happening for over 6 months under the emergency covid order.

Authorize Mayor to execute the amended lease.
