Amendments
At its last meeting, the City Commission voted unanimously to continue the item to tonight's meeting. Since then, staff has added a parking condition for the property. The parking lot currently has 41 existing parking spaces with 25 of those spaces being required for the Stuart Arches office building and 2 spaces required for the Walton Building once it is relocated. (applying a 50 percent parking credit for historic reuse) See Condition # 9 of Resolution No. 97-2020 attached.
Review Board
The Community Redevelopment Board recommended approval (3-2) for the relocation of the historic Walton Building also known as 33° on August 4, 2020.
Application
The applicant is requesting a Major Urban Code Conditional Use approval under Section 3.01.06 of the City's Land Development Code. If granted, the approval will allow for the building to be moved from its temporary location on city property near Decker Avenue to the north end of the parking lot just west of the Bellsouth building and across the street from the Azul apartments. The applicant has requested the following variances from the urban code:
1. To allow the building to be set back from the front property line to allow for a brick paver
patio with seating,
2. For the front building façade to make up less than 80% of the lot width,
3. To forego the requirement for the minimum building height of two stories, and
4. To forego the requirement for arcades or glazed openings and balconies along the street
façade.
If the applicant's request is granted, a licensed moving contractor will make application to relocate the building, including a routing plan, time frames, surety bonds and/or indemnification of the City for any damages to City property such as the sidewalks and city right-of-way. Mr. Brechbill as owner of 111 Real Estate Holdings must authorize the moving permit.
The applicant has been made aware of the City’s recently adopted Historic Preservation Ordinance. Mr. Brechbill has reviewed the program but does not wish to pursue historic designation or the possibility of tax deferments at this time. Staff has reviewed the application and made the applicant aware of financial assistance, in the form of a 50/50 funds match, not to exceed $2,000 for new mural artwork. Staff has also asked the applicant to consider a permanent shade structure at the front of the relocated building. See CRA letter recommendation attached.
Normally, a condition of approval would be included requiring the applicant to provide a public art fee of one percent of the vertical construction cost including the new foundation and improvements to the building or provide a work of art on site. At its meeting the Community Redevelopment Board recommended approval for the relocation of the Walton Building without requiring a public art component.
