ORDINANCE No. 2441-2020; AN ORDINANCE GRANTING TO PEOPLES GAS SYSTEM, A DIVISION OF TAMPA ELECTRIC COMPANY, ITS SUCCESSORS AND ASSIGNS, A NON-EXCLUSIVE NATURAL GAS FRANCHISE AGREEMENT TO USE THE PUBLIC RIGHTS OF WAY OF THE CITY OF STUART, MARTIN COUNTY, FLORIDA, AND PRESCRIBING THE TERMS AND CONDITIONS UNDER WHICH SAID FRANCHISE MAY BE EXERCISED; PROVIDING FOR SEVERABILITY, PROVIDING FOR AN EFFECTIVE DATE, AND FOR OTHER PURPOSES.
Summary Explanation/Background Information on Agenda Request:
The Franchise Agreement with Peoples Gas System, a Division of Tampa Electric Company expired on May 11, 2020.
Staff has negotiated new terms and conditions of the Franchise Agreement to include:
A provision to identify underground facilities that are less than ten (10) feet from an existing building.
A provision to for emergency response training for the Fire Training.
The Franchise Fee of 6% of Gross Revenues has been determined to be industry standards.
A ten (10) year term with two (2) ten (10) year renewal options.
This Second Reading includes a change in Section 14 of the Agreement that identifies the TECO department that will be responsible for incorporating any changes to the City's boundaries.
