Title of Item:

CHARTER REFERENDUM QUESTIONS (RC):

RESOLUTION No. 60-2020; A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF STUART, FLORIDA PRESENTING REFERENDUM QUESTIONS FOR PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF STUART, FLORIDA; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.

Summary Explanation/Background Information on Agenda Request:

The Charter Review Board made three recommendations for possible referendum questions to be presented to the Voters in the 2020 general election.  During the regular City Commission Meeting on April 27, 2020, the City Commission directed staff to return with draft language for two referendum items.  The first was a referendum to decide if the terms of the City Commissioners should be changed from two years to four years with a maximum years of consecutive service limited to twelve years.  The second question was to add language to the Charter that would require a sitting Commissioner to resign from office prior registering to run for a political seat other than that of City Commissioner.

The proposed ballot language is attached in the Resolution.  Upon approval by the City Commission, the Clerk will submit the language to the Supervisor of Elections to be added to the general election ballot current scheduled for August, 2020.  If the general public adopts either of the amendments, then the matter will return to the City Commission to adopt the appropriate ordinance to implement the will of the voters.

Funding Source:

The cost should be minimal if added to the August election which is already scheduled to occur in the County.

Recommended Action:

Move approval of Resolution 60-2020 authorizing the ballot language.
