Title of Item:
(CONTINUED FROM JANUARY 13, 2020 TO DATE CERTAIN OF JANUARY 27, 2020) AMENDMENT TO EXISTING PUD TO URBAN DESIGNATION AND TO RE-ESTABLISH DEVELOPMENT TIMELINES (RC):
ORDINANCE No. 2421-2020; AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF STUART, FLORIDA, REFRESHING THE NOW DEFUNCT ORDINANCE 2275-2014, AMENDEDING ORDINANCE NUMBER 2095-07, FORMERLY THE “HARBOUR WALK PRESERVE COMMERCIAL PLANNED UNIT DEVELOPMENT” (CPUD) PROJECT; PROVIDING FOR DEVELOPMENT APPROVAL ON A 1.97 ACRE COMMERCIAL PORTION OF THE SITE, TO BE KNOWN AS THE “HANEY CREEK TRUST COMMERCIAL PROPERTY” URBAN PLANNED UNIT DEVELOPMENT (UPUD); PROVIDING FOR CERTAIN DESIGN CONDITIONS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
Summary Explanation/Background Information on Agenda Request:
The subject property consists of 1.97 acres and is located at 1001 NW Federal Highway at the east corner of U.S. 1 and North Shores Boulevard, approximately 600 feet north of Wright Boulevard. The subject property has approximately 275.41 feet of frontage along U.S. 1.
As part of a bookkeeping effort, the City discovered that the Haney Creek Trust CPUD required a certificate of occupancy no later than March 12, 2019. The purpose of this Ordinance is to refresh the now defunct Ordinance 2275-2014, in order to promote leasing of the site to a private commercial enterprise.
Exhibit B of Ordinance 2275-2014 included potential acceptable uses such as restaurants, veterinarian offices, retail sales, etc. A list of prohibited uses is also included. Additionally, proposed development conditions include submittal of architectural plans, tree survey and mitigation, lighting plan, and landscape plan during site plan review. Staff is recommending a change from CPUD to Urban Planned Unit Development (UPUD), and the timeline is extended to January 1, 2023. No other changes are recommended to the conditions of approval for the Haney Creek Trust CPUD.
It is the purpose of this amendment to make the site more marketable and City permit-ready for development. The City Commission would review a specific use at the time of lease assignment.
The draft minutes from the December 12, Local Planning Agency meeting are attached. The LPA voted to approve the item, with Christine De La Vega dissenting. Ms. De La Vega spoke of potential uses such as affordable housing and also asked if a condition could be included that forces the Haney Creek UPUD automatically revert to conservation if this UPUD expires. Staff notes that if adopted, this Haney Creek UPUD will expire on January 1, 2023, should no suitable development occur on the site. After which, the city will once again be able to decide on the future of the site.
MANAGERS NOTE: This property was exchanged for another piece of property that the city owns off Wright Blvd. That piece was not part of the conservation and was held as a city asset for future use. The city put that in conservation in exchange for the US1 piece. Then dedicated the funds derived from the US1 piece for the Haney Creek maintenance.
