RESOLUTION No. 06-2020; A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF STUART, FLORIDA AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE ASSIGNMENT OF THE PELICAN LEASE AGREEMENT LOCATED AT 351 SW FLAGLER AVENUE TO HUDSON'S PLACE LLC, WHICH IS THE ENTITY PLANNING TO OPERATE THE RESTAURANT; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
Summary Explanation/Background Information on Agenda Request:
The property located at 351 SW Flagler Avenue is currently leased by the City to the Pelican Cafe. Pursuant to the terms of the Pelican Lease, the City Commission must approve any assignment or transfer of the agreement and the City has the right to renegotiate the rent. On December 6, 2019, the Pelican Cafe provided the City with an assignment agreement which is attached hereto. The Resolution will authorize the City Manager to negotiate with the proposed entity regarding acceptable terms or changes to the agreement, if any. The final lease agreement and terms will be scheduled for approval by the City Commission of January 27, 2020 if the Commission authorizes the negotiations.
