Title of Item:
CHARTER ADVISORY BOARD APPOINTMENTS (RC)
Summary Explanation/Background Information on Agenda Request:
The City Charter calls for the designation of a Charter Advisory Board in 2020. The Charter Advisory Board (CAB) requirement is as follows:
City Charter, Sec. 10.02. - Charter advisory board.
Within thirty (30) days after the annual organizational meeting convened in the year 2000, and each tenth year thereafter, there shall be designated by the commission, a charter advisory board to consist of residents of said city. The members shall be appointed by, and shall serve at the pleasure of the commission. The charter advisory board shall convene at the call of its chairman, adopt its rules of procedure, examine the charter, hold public hearings, and not later than one hundred eighty (180) days thereafter, file with the commission its proposal or proposals, if any, for revisions to this charter or any part of it.
The following conclusions are made based upon this language:
- The Charter does not prescribe a selection process for CAB members
- The Charter does not prescribe the number or makeup of the CAB, however, CAB members must be City residents
- The Stuart City Commission will make final determination on what actions to take, if any, based upon the proposals submitted by the CAB
