Title of Item:
AMENDMENT TO THE LAND DEVELOPMENT CODE REVIEW PROCEDURES FOR PUD APPLICATIONS (RC):
ORDINANCE No. 2424-2020; AN ORDINANCE OF THE CITY OF STUART, FLORIDA, AMENDING THE EXISTING SECTION 11.01.00 OF CHAPTER XI ENTITLED “PROCESSING OF PLAN APPLICATIONS” TO AMEND THE REVIEW BOARD PROCEDURES FOR PROPOSALS THAT INVOLVE URBAN PLANNED UNIT DEVELOPMENT LOCATED WITHIN THE COMMUNITY REDEVELOPMENT AREA; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; AND PROVIDING FOR AN EFFECTIVE DATE, AND FOR OTHER PURPOSES.
Summary Explanation/Background Information on Agenda Request:
This proposed Ordinance follows the adoption in April 2019 of Ord 2401-2019 by City Commission, which provided for the use of planned unit development agreements in the form of Urban Planned Unit Development (UPUD) within the urban district and expanded Community Redevelopment Area.
The duties of the Community Redevelopment Board (CRB) includes the review and provision of advisory recommendations relating to development applications that require amendment to the urban code (Sec 8.00.04 Land Development Code). UPUD applications involve review of the urban code.
The existing review procedures do not take account of the Urban PUD application in that UPUD applications are not directed to the CRB. This proposed amendment provides a distinct route for advisory board review for UPUD applications that are located within the Community Redevelopment Area.
This Ordinance was presented to the Local Planning Agency (LPA) on December 12th, 2019. The Agency recommended amendments to the proposed code such that only major amendments to existing PUD agreements within the defined CRA should be considered by the CRB as the advisory board.
