ORDINANCE No. 2416-2019; AN ORDINANCE OF THE CITY OF STUART, CREATING DIVISION B IN ARTICLE IX, CHAPTER 20 OF THE CITY CODE RELATED TO REGULATIONS FOR THE DISTRIBUTION OF SINGLE-USE PLASTIC STRAWS BY FOOD SERVICE ESTABLISHMENTS; PROVIDING FOR A SEVERABILITY CLAUSE AND A CONFLICT CLAUSE; PROVIDING FOR AN EFFECTIVE DATE, AND FOR OTHER PURPOSES.

 


Summary Explanation/Background Information on Agenda Request:

Ordinance 2416-2019 prohibits the distribution of straws by commercial businesses within the geographic limits of the City of Stuart. The ordinance provides for a warning process until December of 2020 and then a fine schedule beginning in 2021.  Further, the ordinance does not require customers of a drive through business to request a straw but beginning in 2021, no businesses including drive through services shall be allowed to issue or distribute plastic straws.  Non-plastic straws shall be allowed but only by request only.  This ordinance applies to all businesses in Stuart and is not limited to property owned by the City.

 

The Commission approved the Ordinance on First reading without any alterations.
