RESOLUTION No. 53-2019; A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF STUART, FLORIDA AUTHORIZING THE EXECUTION OF A LICENSE AGREEMENT BETWEEN COLAB KITCHEN, LLC, LLC TO OPERATE A HYDROPONIC GROWING FACILITY ON “PARCEL 1” OF THE 3.34-ACRE BRUNER POND PARK PROPERTY ON S.E. MARTIN LUTHER KING JR. BLVD., STUART PURSUANT TO THE TERMS OF THE LICENSE AGREEMENT.
Summary Explanation/Background Information on Agenda Request:
In September, 2014, the City Commission adopted Resolution No. 88-2014 authorizing a license agreement to Ground Floor Farm, LLC allowing the installation and operation of a hydroponic growing facility on "Parcel 1" of the 3.34-acre Bruner Pond Park property on S.E. Martin Luther King Jr. Blvd., for a period of seven (7) years. The Agreement would expire in September, 2021. The agreement also contemplated assignment. Ground Floor Farms is selling the adjacent property and the purchaser, CoLab Kitchen LLC has requested that it be allowed to operate the farming property pursuant to the license agreement for the balance of the license agreement. Instead of assigning the original agreement, it was determined that a separate license would be easier to manage. The proposed agreement would begin June 1, 2019 and expire at the end of September, 2021. All terms of the original agreement would remain the same as demonstrated in the proposed license agreement attached as exhibit A.
