Summary Explanation/Background Information on Agenda Request:
The City had been collecting the impact fees and remitting them to the County from the time the last interlocal was established in 2000 until October 2016. While evaluating the impact fees collected by the City, the City's consultant looked at the interlocal and County’s impact fee calculation methodology, and determined, in their opinion, there were ‘flaws’, and based on the consultants recommendation the City discontinued remitting the impact fees to the County until there could be an agreement among the parties to satisfy any discrepancies. The City and County were asked by each of their respective Boards to have staff work together and develop a solution. Staff began meeting immediately trying to reach some form of resolution.
After significant discussion between the County and City as well as input from independent consultants hired by both the County and the City, an updated interlocal agreement has been drafted and is recommended for approval to replace the prior agreement.

Motion to approve Resolution 112-2018 authorizing the Mayor to execute a new interlocal agreement with Martin County related to the collection of future impact fees generated by projects within the municipal borders of the City and further to transfer the funds currently being held by the City directly to Martin County. |
