(QJ)(RC)

Summary Explanation/Background Information on Agenda Request:

On October 8, 2018 the City Commission unanimously approved Ordinance 2385-2018 on first reading.

On February 25, 2008, the City Commission approved Ordinance No. 1545-08 for Windemere Point Commercial Planned Unit Development, allowing for the construction of a 77,300 square foot commercial shopping center which included the LA fitness building.  Later that year, the City Commission approved an amendment to the site plan to allow an extension for the installation of the traffic signal at US-1 and Windemere Drive. Since then, several extensions to the timetable for development have been granted with phase 3A just now being completed for a medical office and phase 3b for a restaurant to be completed in the future.

Currently, the approved uses for the project are limited to retail, restaurant and a fitness center. The purpose of this amendment is to clarify and expand the uses for lots 1, 2 and 3 to include medical and service related uses.

Since the last approval, certificates of occupancy have been issued for phase one and phase two of the project that include the Dunkin Donuts,  Velvet Nails, Captiva Tan, and Elements Massage.  I Vitamin Lounge (medical office) is currently being built out for tenant move in later this year.

In conclusion, available parking can accommodate the existing and proposed tenant build-out uses for Lots 1, 2 and 3.  In addition, the current and proposed uses can be accommodated on the site without further review for parking demand.  See Exhibit D, Site Plan by Gallo Herbert Architects sheet AS-101 dated 05.22.18 and a Parking Study for Windemere Point conducted by Traffic Impact Group, LLC dated May 15, 2018
